F-Gas Regulations for UK Hospitality & Retail: Are You Legally Compliant?

If you run a hotel, restaurant, convenience store, or pub, commercial refrigeration and air conditioning are the backbone of your day-to-day operations. However, many business owners do not realise that under UK law, the operator of the equipment (the business owner or leaseholder), not just the contractor, is legally responsible for F-Gas compliance.

Fluorinated greenhouse gases (F-Gases) like hydrofluorocarbons (HFCs) are subject to strict environmental controls enforced by the Environment Agency and DEFRA. Failing to maintain your systems or keep proper records can result in substantial civil penalties and statutory enforcement notices.

Here is what hospitality and retail operators need to know to ensure their refrigeration and air conditioning systems remain fully compliant.

1. What Are the Operator’s Legal Duties?

Under retained GB F-Gas legislation, if you own or operate commercial refrigeration or climate control equipment, you are legally required to:

  • Prevent Leakage: Take all precautionary measures to prevent fluorinated gas leaks and repair any detected leaks immediately.

  • Mandatory Leak Checks: Carry out regular, certified leak tests based on the carbon equivalent tonnage of the system.

  • Maintain Accurate Records: Keep detailed, audit-ready F-Gas logbooks for every qualifying piece of equipment on-site for at least 5 years.

  • Use Certified Engineers: Ensure that only certified technicians holding valid F-Gas qualifications (such as City & Guilds 2079 or equivalent) and working for a REFCOM-registered company work on your refrigeration circuits.

  • Ensure Proper Recovery: Recover all refrigerants during maintenance, servicing, or decommissioning using a licensed waste carrier.

2. Mandatory Leak-Testing Frequencies

Leak-checking requirements are not based on the physical weight of the gas in kilograms alone, but on its Global Warming Potential (GWP) converted into tonnes of carbon dioxide equivalent ($CO_2$e).

You calculate $CO_2$e by multiplying the gas charge (in tonnes) by its GWP rating. The mandatory testing schedules are:

  • 5 to 50 Tonnes $CO_2$e: Must be leak-checked at least once every 12 months (or every 24 months if an automated leak detection system is fitted).

  • 50 to 500 Tonnes $CO_2$e: Must be leak-checked at least once every 6 months (or every 12 months with an automated leak detection system).

  • 500+ Tonnes $CO_2$e: Must be leak-checked at least once every 3 months. An automatic leak detection system is mandatory.

Example: A standard walk-in freezer holding just 2.6 kg of R404A has a GWP of 3,922, equaling over 10 tonnes of $CO_2$e. That single freezer legally requires a certified leak test every 12 months.

3. What Needs to Be in Your F-Gas Logbook?

If an Environmental Health Officer (EHO) or Environment Agency inspector visits your premises, you must produce an F-Gas logbook on demand. For every commercial system containing 5 tonnes $CO_2$e or more, the log must detail:

  1. The exact quantity and type of refrigerant installed.

  2. Any quantities of refrigerant added during maintenance.

  3. Quantities of refrigerant recovered during servicing or disposal.

  4. The dates and results of all statutory leak tests.

  5. The name, certification details, and REFCOM registration number of the engineer and company who performed the work.

4. What Happens After a Leak Is Repaired?

If an engineer identifies and repairs a refrigerant leak on your system, the law does not stop there. Under F-Gas regulations:

  • The system must be re-tested within 1 month of the repair to confirm that the fix was completely effective.

  • This follow-up inspection must be formally recorded in your digital logbook.
